These terms of use govern the use of the "Now Altimeter" app for iOS and Android. By downloading or using the app you agree to these terms.

Scope

The app is provided by Gerhard Kanzler (contact details at the end of this page and in the imprint). These terms apply to both the free and the paid use of the app.

Services

The app shows the current altitude based on the device's GPS and – where available – barometer data, and offers features such as coordinate display, compass, track recording and design customization. Advanced features ("Pro") are available via a paid subscription.

Subscription, pricing and automatic renewal

Pro is available as a monthly or yearly subscription; the applicable prices are shown in the app before purchase. Purchase and billing are handled through your account in the respective app store (Google Play or Apple App Store); the provider does not receive or store any payment data. The subscription renews automatically for the selected period unless cancelled at least 24 hours before the end of the current period. Charging for the renewal occurs within 24 hours before the current period ends.

Cancellation

You can manage and cancel your subscription at any time in the settings of your app store account. Cancellation takes effect at the end of the current billing period.

Licence and obligations

You receive a simple, non-transferable right to use the app for private purposes. Your own content (e.g. background images for designs) must be free of third-party rights; you are responsible for it. Any unlawful or abusive use is prohibited.

Accuracy and liability

The displayed altitude, position and air-pressure values are based on device sensors and may be inaccurate. The app is not intended for safety-critical purposes (e.g. aviation, mountain rescue, navigation) and must not be used as the sole basis for decisions. The provider is liable without limitation for intent and gross negligence and under product liability law; for ordinary negligence only for the breach of essential contractual duties and limited to foreseeable damage.

Changes and governing law

The provider may amend these terms with effect for the future where there is good reason to do so; you will be informed of material changes. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of your country of residence remain unaffected.
